Judge Martin Stone has extended the hearing on Bandon resident Monte Callaway, who is facing charges including attempted murder from a February shooting.
Callaway, 47, spent about a month in the hospital recovering from his wounds before appearing in court, then was put under house arrest instead of taken into custody because of his poor health. He was allowed to leave his brother’s residence, located outside Bandon city limits, but only to visit court, his doctor and his lawyer, but was seen shopping at Price ’n’ Pride last Wednesday. After a hearing before Stone on Friday, Callaway was taken into custody on $500,000 bail.
Frasier said he is unsure what medical procedures Callaway may still need, but it is evident house arrest is no longer appropriate.
“If he’s well enough to go to the grocery store, he’s well enough to go to jail,” Frasier said.
A change of plea hearing was held on Monday in Judge Stone’s courtroom.
Dressed in jail garb after breaking his release agreement, Callaway let his lawyer, Ron Cox, do most of the talking. The hearing mainly consisted of scheduling the next court date. Stone agreed to give Cox more time to review his case and set the next hearing for 8:30 a.m. on Monday, July 28.
Callaway is facing charges, including attempted murder, following a February tavern shooting in Bandon.
The criminal case stems from a Feb. 21 shooting at a Bandon tavern, where both Callaway and an employee, Paul Conner, suffered gun shot wounds and were sent to the hospital. According to the Coos County District Attorney’s office and court records, a suspect police identified as Callaway entered the tavern armed with a shotgun and fired shots at Conner, striking him in the head. Callaway turned the weapon on himself, shooting himself in the face.
On April 3, a grand jury returned indictments charging Callaway with attempted murder with a firearm, first-degree assault with a firearm, second-degree assault with a firearm, unlawful use of a firearm, and three separate charges of recklessly endangering another person.
